Pinkberry, the trendy frozen yogurt brand, loses lawsuit over its ingredients
Pinkberry the very trendy frozen yogurt brand that has taken LA and NY by storm generating nightclub like lines outside their tiny locations has settled a class-action lawsuit over its ingredients.
The suit claimed successfully that the brand's ingredients and production process as originally introduced made it not real frozen yogurt. The product was shipped in powder form to each location and then mixed with water. This violated state food guidelines for frozen yogurt that requires off-site mixing and preparation.
Pinkberry now mixes the product off-site at a dairy.
As part of the settlement, Pinkberry will give a total of $750,000 to two Southern California charities; one a food bank, the other a child-care group.
The attorney that brought the suit is said to be involved with one of Pinkberry's competitors and was quoted as saying "we're very happy" about the lawsuit's success.
Since the suit was filed, Pinkberry has opened many locations across the US and in my opinion has already lost its cache. There are no longer long lines to buy the product and frozen yogurt lovers are now touting Red Mango as the "hot" brand. Fame is fleeting especially with trendy food.
